18) Allah and judicial law

  • Lets talk about Hammurabi judicial law from 4000 years ago and find the similarities with Allah (Islam) laws. An Epigraph was found more than 100 years ago near Baghdad in Iraq 2.5 meter high and it is translated. This epigraph is written in the name of Hammurabi king. This epigraph contain of 1114 lines, 16 paragraph and 282 judicial laws. Hebrew scholars borrowed 10 commandments from Hammurabi law. 2600 years later Allah inspired Mohammad with the similar law as Hammurabi law.

We will compare some Hammurabi law and Allah's law.

Allah law from 1400 years ago:
Sureh 2 (AL-baghareh), verse 178. O you who believes, Punishment (revenge) has been prescribed for you in the case of murdered people: the freeman for the freeman, and the slave for the slave, and the female for the female. And for him who is forgiven somewhat by his (injured) brother, prosecution according to usage and payment unto him in kindness. This is an alleviation and a mercy from your Lord. He who transgressed after this will have a painful doom.
Verse 179:
And there is life for you in retaliation, O men of understanding, that ye may ward off (evil).
Note: As you read above Allah called the retaliation "life". This is an interesting point that there are many reason for murder but how can you call retaliation "life". Allah teaches the worst judicial law and called the people who shall execute this law "wisdom and men of understanding".

Hammurabi code from 4000 years ago:
code 196:
If a man put out the eye of another man, his eye shall be put out. An eye for an eye
Code 197: If he break another man's bone, his bone shall be broken.
Code 198: If he put out the eye of a freed man, or break the bone of a freed man, he shall pay one gold Mina.
Code 229: If a builder build a house for some one, and does not construct it properly, and the house which he built fall in and kill its owner, then that builder shall be put to death.
Code 230: If it kill the son of the owner the son of that builder shall be put to death.
Note: Code 230 is being executed in some Muslim countries today (A code of 4000 years ago).

Note: Hammurabi code explained different type of murders and situation but the punishment law in Quran is very generic.

Conclusion: Allah judicial law is a copy from Hammurabi law in 4000 years ago.

Law of stoning:

Stoning law for men or women who had sexual relation with other than their husband/wife.
Please see YouTube for stoning:
http://www.youtube.com/watch?v=fPqNCr8KKdU

Hammurabi law from 4000 years ago:
Code 153:
If the wife of one man on account of another man has their mates (her husband and the other man's wife) murdered, both of them shall be impaled.

Coping the law from 4000 years ago and executing this barbarian law after 2600 years in the name of Allah and even in 21st century is a question mark. How people can watch and tolerate this barbarian act?

====================================================================
Hammurabi law is even more progressive than Allah law
Allah law for polygamy:

Sureh 4 (Al-Nesa), Verse 3: Men are allowed to marry 4 Muslim women and unlimited women who are captured during war or slaves.
Hammurabi law from 4000 years ago:

Code 144: If a man take a wife and this woman give her husband a maid-servant, and she bear him children, but this man wishes to take another wife, this shall not be permitted to him; he shall not take a second wife.

Conclusion: Although the Hammurabi law is not even executable in today's life but if you compare with the Allah law then you will find the Hammurabi law from 4000 years ago is more progressive than a Allah law which came 2600 years after.

Alimony Law:

Allah Alimony law:

Sureh 2 (Al-Bagareh), Verse 229 to 237: Men shall pay the alimony to women based on his income and nothing is mentioned or specified for children alimony even in detail such as Hammurabi law.

Hammurabi law for Alimony from 4000 years ago:

Code 137:
If a man wish to separate from a woman who has borne him children, or from his wife who has borne him children: then he shall give that wife her dowry, and a part the field, garden, and property, so that she can rear her children. When she has brought up her children, a portion of all that is given to the children, equal as that of one son, shall be given to her. She may then marry the man of her heart.
Code 138: If a man wishes to separate from his wife who has borne him no children, he shall give her the amount of her purchase money and the dowry which she brought from her father's house, and let her go.

Code 139:
If there was no purchase price he shall give her one Mina of gold as a gift of release. Code 140: If he be a freed man he shall give her one-third of a Mina of gold.

Conclusion: If we compare Allah law and Hammurabi law there is no measure in Allah law and nothing specified except in very generic form the alimony is based on income while Hammurabi law is more practical even it was 2600 years before Allah law.
If you pay attention Allah law for alimony talks more about Allah and men than about the alimony law and its detail.

Law for punishing prison personnel if they act injustice

Allah law:
There is no law for injustice acts by prison personnel.
Hammurabi law from 4000 years ago:

Code 116:
If the prisoner die in prison from blows or maltreatment, the master of the prisoner shall convict the merchant before the judge. If he was a free-born man, the son of the merchant shall be put to death; if it was a slave, he shall pay one-third of a Minna of gold, and all that the master of the prisoner gave he shall forfeit.

Allah forgot about this important law to make sure the prison personnel don't act injustice and their punishment if the act
injustice.

Law for punishing thieves

I did some research but could not find similarity between Allah's law and Hammurabi or Faraon law for punishing thieves. Therefore I can conclude this is the only law that is from Allah without coping from others and shows his creativity.

Sureh 5 (Al-Maedeh), Verse 38:
As for the thief, both male and female, cut off their hands. It is the reward of their own deeds, an exemplary punishment from Allah. Allah is Mighty, Wise.

Usually people who steal are hungry or they need to be educated or get help to stop stealing. Allah should give them two more hand (symbolic hand) in order to survive and bring the bread for their family not making them handicap so they will be more dependable to others for their daily life. Even if the thief realize that stealing is not right after cutting his/her hand has not chance to work and live normal life.

17) Allah and science part 3 (Geology)

Allah has mentioned about 30 times talks about mountains in different Sureh and verses. In few verse analysis the mountain in more detail.
  • Sureh 16 (Al-Nahl), verse 81: Allah has created mountains for people to use it as shelter.
  • Sureh 27 (Al-Naml), Verse 88: Allah mentioned to Mohammad: Do you think that the mountains are not moving? The mountain are moving like the clouds.
  • Sureh 78 (Al-Nabaa), Verse 7: Allah made the mountains like spikes to prevent earth's trilling. This means that Allah believes that the earth is flat so spikes will prevent the trilling of the earth.
  • Sureh 20 (Taha), Verse 105: ....Mohammad they will ask you about the mountain and you tell them Allah will chopped them in small pieces in resurrection day.
Allah uses mountains in most of the verse as a symbol of fear.
  • Sureh 2 (Al-bagareh), Verse 74: .... Some of the stones will fall from the fear of Allah.
Here few questions can be asked:
1) Why all stones are not falling?
2) Why All stones are not fearful from Allah?

There are about 10 verse the word stone is mentioned and all in relation with the fear and punishment of unbelievers stories.

16) Allah and deceitful behavior

Allah has repeatedly mentioned in Quran about his deceitful behavior. I refer to two verse that clearly talks about Allah and his deceitful behavior.
  1. Sureh 3 (Al-Emran), Verse 54: ... And Allah is very deceitful (towards unbelievers)
  2. Sureh 7 (Al-Aaraf), Verse 99: Anyone who thinks is safe from this deceitful Allah will be hurt and nobody can escape Allah and his tricks.
Conclusion: Allah teaches to Muslims believers to be deceitful and tricky, lie when needed
In second verse nobody can count on any Muslim believers promise, etc

15) Allah and science part 2 (Geology)

It is important to know that Allah mentioned in Quran repeatably that Allah is:
  • - Allah-o-Yalam (Allah knows)
  • - Allah-al-Hakim (Allah is knowledgeable)
  • - Allah-al-Hakim-al-Khabir (Allah is very knowledgeable), etc
We will find out from Quran whether this true.
The key word is "farsh". The word "farsh" means rugs.
  1. Sureh 55 (Al-Rahman), Versus 54: Believers are seating on the "farsh" rugs that are waived from silk.
  2. Sureh 6 (Al-Anam), Versus 142: Animals (domesticated) are used for the transport and from the wool they make "farsh" rugs.
Therefore "farsh" means rugs as we read in above Sureh. We know that "farsh" rugs has two dimensions. In many versus Allah reffers to "farsh" when talking about the forms of the earth.
  1. Sureh 51 (Al-Zariat), Versus 48: Earth is created like "farsh" rugs.
  2. Sureh 71 (Noha), Verus 19: Earth is created like "farsh" rugs for you.
  3. Sureh 88 (Al-ghashieh), Verus 20: And see how flat is the earth created by Allah
How can Allah be the creature of the earth while he does not know the correct form of the earth? As we read above Allah always refers to earth as a flat and rugs shape.

Note: I only refer to few places in quran while always the reference to earth is as flat, rugs shape,...
